Aguilera Release Controversy in Murder Case

Defense fights Aguilera's pre-trial detention in a 2017 murder case. Prosecutors argue release poses a threat due to gang ties and criminal history. Court's decision sparks public safety concerns. Sunnyvale shooting.
Defense Argues for Aguilera’s Release
Replacement Public Protector Jennifer Redding, Aguilera’s defense attorney, filed the movement seeking his release from pre-trial custody in October and claimed that her customer had not been associated with the capturing and has strong connections to the area.
According to The Mercury Information, Replacement Alternating Protector Kristin Carter, who stands for Sandoval, said in court that her customer “hasn’t devoted a felony and hasn’t hurt any individual” because the supposed murder.
“I believe that there’s a range in which courts can choose that are reasonable and affordable people can differ. The factor I’m speaking out concerning this instance is this is not an affordable decision. This is outside the bounds of what’s acceptable and it threatens to the general public,” he included.
“There is no evidence that Mr. Aguilera, specifically with (supervised release) problems, would certainly offer any kind of threat of physical harm to others,” Redding created. “Mr. Aguilera is motivated to clear his name. … There is no compelling passion in apprehending Mr. Aguilera on public safety and security grounds or out of issue he is a trip threat.”
The instance went cold till 2024, when investigators with the Sunnyvale Department of Public Security determined the suspects in 2024. Both males were charged with the murder of Salgado, however a spokesman for the Santa Clara County Area Lawyer told Fox News Digital that Sandoval was the driver of the vehicle that shots were discharged from.
“There is no proof that Mr. Aguilera, especially with (monitored release) conditions, would certainly offer any type of threat of bodily damage to others,” Redding created. “Mr. Aguilera is encouraged to remove his name. … There is no engaging passion in apprehending Mr. Aguilera on public security premises or out of problem he is a flight danger.”

“It was bad enough that a charged murderer with a terrible past was let out of protection, now there are 2. The odds of re-offense or taking off from justice just increased. People’s lives ride on those probabilities,” Rosen claimed.
“This is a person that not only committed a murder, that’s not just been to prison once, yet has been to a jail two times, and is a documented gang participant, this is a dangerous person, and I’m the district attorney and as the principal police officer, my task is to protect this neighborhood’s safety,” Rosen said. “This person is definitely a risk to our community.”
“The court is wagering he does not present a danger to public security due to the fact that he has actually not been arrested for the last couple of years,” the DA’s workplace said in the declaring asking Ramon to reconsider Aguilera’s launch. “The court ought to offer equivalent weight to his criminal history … and the fact that he brazenly murdered a stranger in front of a group due to the fact that the stranger was drunk and mouthing off.”
